Resumen
O presente artigo discute a questão dos Organismos Geneticamente modificados (OGM), sob o aspecto jurídicoe as possibilidades de responsabilização em razão de eventuais danos causados ao meio ambiente por estes. Para tanto analisa os requisitos gerais para a responsabilização civil. Em seguida, discute a responsabilidade do Estado em caso de danos ao meio ambiente causados por OGM que foram liberados pelos órgãos ambientais ou para os quais foi concedido licenciamento ambiental. Posteriormente, destaca a problemática da quantificação do dano e de seu valor reparatório; além de realizar uma relação entre dano ambiental e dano patrimonial. Por fim, aponta as dificuldades em se identificar o causador do dano ao meio ambiente e efetivar sua responsabilização. Em conclusão destaca a falta de parâmetros claros existentes na legislação sobre o tema da reparação de danos ao meio ambiente.Palavras-chave: OGM, meio ambiente, dano ambiental.GENETICALLY MODIFIED ORGANISMS AND THEIR DEMAGE REPAIR TO THE ENVIRONMENT: brief observations on the lawAbstract: This article discusses the issue of Genetically Modified Organisms (GMOs) considering the legal aspects that surrounds this matter. It also explores the potential liability due to the damage caused to the environment because of genetically modified organisms. Towards the objective we analyzed the general requirements for civil liability. The article also discusses the State?s liability for damage to the environment caused by GMOs that were released by environmental agencies or for which they were granted with an environmental license. Afterwards the article highlights the problem of quantifying the damage and the reparative value that these issues might involve; it also accomplishes to highligth a relationship between environmental damage and damage to property. Finally, it indicates the difficulties in identifying the cause of damage to the environment and enforces accountability. The articlés final conclusion underscores the lack of clear benchmarks in the legislation on the issue of compensation environmental demage.Keywords: GMO, environment, environmental damage.
